StumpPro – Terms of Use

StumpPro is owned and operated by Blake Zuill, New Zealand

1. Service Overview and Acceptance

StumpPro is a cloud-based business management platform designed for stump grinding, tree removal, and arborist businesses. The service (the "Platform") includes quoting, invoicing, job management, expense tracking, and business analytics features.

By accessing or using StumpPro, you agree to these Terms of Use. If you do not agree with any part of these terms, you must not use the Platform.

2. Who Can Use StumpPro

To use the Platform, you must:

  • Be at least 18 years old
  • Be a legitimate business owner or authorized representative of a business
  • Agree to use the Platform only for lawful business purposes
  • Comply with all applicable laws and regulations in your jurisdiction

3. Account Registration and Your Responsibilities

When you create an account, you agree to provide accurate, current, and complete information. You are responsible for:

  • Keeping your login credentials confidential and secure
  • Notifying us immediately of any unauthorized access
  • All activity that occurs under your account
  • Ensuring your use complies with all applicable laws
  • Verifying that all data you input does not infringe third-party rights

4. Free Trial Terms

StumpPro includes a 14-day free trial for new accounts:

  • No payment is required to start the trial
  • You will receive full access to all Platform features during the trial period
  • After the 14-day free trial ends, your subscription will begin automatically and you will be charged through Apple's In-App Purchase system unless you cancel before the trial period expires
  • At the end of the trial, your access will be suspended unless you purchase a subscription
  • You must cancel before the trial ends to avoid being charged for a subscription
  • We reserve the right to limit or discontinue free trials at any time

5. Subscriptions and Billing

StumpPro operates on a monthly recurring subscription model:

  • Payments are processed securely through Apple's App Store using Apple's In-App Purchase system
  • Your subscription automatically renews each month unless cancelled through your Apple Account settings
  • Charges are applied on the same date each month as your initial purchase
  • You can manage your subscription, cancel, or update payment details via your Apple Account → Subscriptions
  • Your 14-day free trial begins when you first create your account. No payment is required during the trial period

5A. Refund and Cancellation Policy

All subscription billing is managed by Apple through the App Store In-App Purchase system. As a result:

  • Refund requests must be submitted directly to Apple. We do not have access to your payment information and cannot process refunds on Apple's behalf
  • To request a refund from Apple, visit reportaproblem.apple.com or go to Settings → Apple ID → Purchase History
  • Apple's standard refund policy applies to all StumpPro subscription purchases
  • Cancelling your subscription stops future billing but does not automatically generate a refund for the current billing period
  • At our discretion, we may offer goodwill remedies (such as extended trial access) in exceptional circumstances — contact us at support@stumppro.app

Statutory Rights: Nothing in this Refund Policy limits your rights under the New Zealand Consumer Guarantees Act 1993, the Australian Consumer Law, or other applicable consumer protection legislation. Where a service fails to meet a statutory guarantee, you may be entitled to a remedy regardless of this policy.

6. Cancellation and Access

You can cancel your subscription at any time:

  • Cancellation is managed through your Apple Account → Subscriptions
  • Your access to the Platform continues until the end of your current billing period
  • Once your billing period ends, your account will be suspended and you will no longer be able to log in
  • You are responsible for exporting or backing up your data before your access ends
  • We recommend downloading all necessary quotes, invoices, and business data before cancellation

7. Acceptable Use

You agree to use StumpPro only for lawful business purposes. You must not:

  • Resell, sublicense, or provide access to the Platform to others
  • Use the Platform to create competing products or services
  • Attempt to reverse-engineer, hack, or compromise the Platform's security
  • Upload malicious code, viruses, or harmful content
  • Use the Platform for illegal activities or to violate third-party rights
  • Harass, abuse, or threaten other users or staff
  • Use automated tools (bots, scrapers) without written permission

8. Data Ownership and User Content

You retain ownership of all information, documents, photographs, invoices, customer records and other content you upload to StumpPro, including:

  • Business information and quotes
  • Client contact details and job records
  • Invoices and financial data
  • Expenses, assets, and other business records

You are responsible for ensuring you have all necessary rights and permissions to upload and use that content.

By uploading content to StumpPro, you grant Blake Zuill and StumpPro a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit and display that content solely for the purpose of operating, maintaining, securing, backing up and improving the Platform and providing the Services requested by you.

This licence does not transfer ownership of your content and ends when your content is permanently deleted from our systems, except where we are required to retain data for legal, compliance or disaster recovery purposes.

StumpPro does not claim ownership of your data and will not sell, share, or use your data for commercial purposes outside of operating the Platform. See our Privacy Policy for full details on how we handle your data.

9. AI Features – StumpCoach

StumpPro includes StumpCoach, an AI-powered business insights tool:

  • StumpCoach sends anonymised summaries of your business metrics (revenue, job counts, expenses) to an AI service
  • No client personal data, contact details, or individually identifiable information is sent to the AI
  • The AI generates business insights and recommendations based only on aggregated metrics
  • Your data remains encrypted and isolated from other users
  • You can disable StumpCoach at any time in your account settings

10. Limitation of Liability

StumpPro is provided "as is" without warranties. To the maximum extent permitted by law:

  • We do not guarantee the accuracy of quote calculations, pricing estimates, or financial projections generated by the Platform
  • We are not liable for financial decisions you make based on quotes, invoices, or data within the Platform
  • We do not warrant uninterrupted, error-free operation of the Platform
  • We are not responsible for data loss due to user error, system failures, or circumstances beyond our control

Our total liability to you is limited to the greater of: (a) the amount you have paid in the past 3 months, or (b) NZ$50. This applies to all claims, including breach of contract, negligence, and indirect damages.

10A. Availability of the Platform

We do not guarantee uninterrupted availability of the Platform. Maintenance, updates and unforeseen outages may temporarily affect access.

10B. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including internet outages, cloud provider failures, natural disasters, cyber attacks or government action.

11. Intellectual Property

All software, source code, branding, trademarks, user interface designs and documentation relating to StumpPro remain the intellectual property of Blake Zuill unless otherwise stated. You may not:

  • Copy or reproduce the Platform or its features
  • Reverse-engineer or decompile the software
  • Use our branding or logos without permission

11A. Feedback

If you provide feedback or suggestions regarding StumpPro, you grant us the right to use that feedback without restriction or compensation.

12. Suspension and Termination

We may suspend or terminate your account if you breach these Terms or engage in illegal activity. Upon termination:

  • Your access to the Platform will be immediately revoked
  • You will have 30 days to request a download of your data
  • After 30 days, we may permanently delete your data

13. Global Use and Local Compliance

StumpPro is operated from New Zealand but is accessible globally. By using the Platform, you acknowledge that:

  • You are responsible for understanding and complying with local tax, employment, and business laws in your jurisdiction
  • You are responsible for compliance with applicable data privacy laws in your jurisdiction, including (where relevant) the New Zealand Privacy Act 2020 and the Australian Privacy Act 1988
  • StumpPro is not responsible for your failure to comply with local regulations

13A. Export Responsibility

You are responsible for maintaining copies of any records required under applicable taxation or business legislation.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Zealand. Any legal disputes will be resolved in the courts of Auckland, New Zealand, unless local law requires otherwise.

15. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated via email or in-app notification. Your continued use of the Platform after changes constitutes acceptance of the new Terms.
